Agreeing to these terms
These terms cover your use of the Agawam Concrete website and any work you hire us to do. By using the site, calling us or booking a job, you agree to them, so if you don't agree, please don't use the site, and contact us with any questions before you book.
Agawam Concrete is a concrete contractor in Agawam, MA. In these terms, "we", "us" and "our" mean Agawam Concrete and our crew, and "you" means the person using the site or hiring us.
What we do
We build and repair concrete for homes and businesses in Agawam and the cities around it. That includes driveways, patios, sidewalks, steps, garage floors, foundations, retaining walls and related work. You can read more about who we are on our About page.
The service descriptions, photos and examples on our home page and elsewhere on the site are general information. They don't promise that a method, finish or result fits your property. The work we agree to do for you is the work written in your estimate or contract, and that document controls if it differs from anything on the site.
Estimates and pricing
We give free estimates after we see the site, because the ground, drainage, access and the condition of any old concrete all change the job. Any cost information on this website is general and isn't a quote. Prices in an estimate can change after the date written on it because material costs move.
Some conditions only show up once the old concrete is out. These include soft or wet subgrade, which is the soil the slab sits on, as well as buried debris, roots or rock. If we find something that changes the scope or the price, we stop and talk with you first, and we don't do extra work without your written approval.
Scheduling, weather and cancellation
We set a start date when you accept the estimate. Rain, freezing temperatures and high heat all affect how concrete sets and cures, so we may move a pour to protect the work. We'll tell you as soon as we know. Delays from weather, supplier shortages, permit or inspection timing, or anything else outside our control are not a breach by either side.
You agree to give our crew clear access to the work area and to keep vehicles, pets and people out of it while we work. Tell us about anything buried that isn't marked, such as sprinkler lines, septic parts or private wiring. We aren't responsible for damage to buried items we weren't told about.
New concrete needs time to cure, which is the waiting period while it hardens and gains strength. Keep foot traffic and vehicles off it for the time we give you, because damage from using it early isn't covered.
If you need to cancel or reschedule, call us at (413) 789-3945 or reach us through the contact page as early as you can. If you cancel after we've ordered materials or started work, you pay for the materials ordered and the work done up to that point, as your contract describes. These terms don't take away any cancellation rights the law gives you.
Payment
Your contract sets out any deposit and when each payment is due. Final payment is due when the work described in the contract is complete.
If a payment is late, we may pause work until it's paid. We may also use the remedies the law allows to collect it, including a lien on the property where the law permits one.
Our guarantee and what it doesn't cover
We stand behind our work, and satisfaction is guaranteed on every job. If something isn't right, call us and we'll come look at it. Where the problem comes from our workmanship, we'll make it right. Any written warranty in your contract sets the specific terms for your job.
Concrete shrinks as it cures and moves with frost, so hairline cracks can happen even in a well-built slab. We cut control joints, which are grooves that give the slab a planned place to crack, to keep cracking where it's least noticed. Even so, we can't promise a slab will never crack. Hairline cracks, small color differences and minor surface variation are normal for concrete and are not defects.
Our guarantee doesn't cover damage from de-icing salts or chemicals, from loads heavier than the slab was built for, or from tree roots. It also doesn't cover settling of ground we didn't prepare, drainage changes made by others, misuse, or not following the care instructions we give you.
Except as stated in your contract, this website and its content are provided as is, without warranties of any kind, to the extent the law allows.
Limits on our liability
To the extent the law allows, we aren't liable for indirect or consequential losses. These include lost use of a driveway or patio while concrete cures, or costs from delays outside our control. Our total liability for any claim about a job is limited to the amount you paid us for that job.
Nothing in these terms limits liability that the law doesn't allow to be limited, such as for injury caused by our negligence. Agawam Concrete is licensed and fully insured.
Using this website
The text, photos and design on this site belong to Agawam Concrete. You may not copy or reuse them without our permission. We try to keep the site accurate, but it may contain errors or out-of-date information, and we can correct it at any time.
Links to outside websites are there for your convenience. We don't control those sites and aren't responsible for what they say or do.
Settling a disagreement
If you have a problem with our work, call us first, because most issues are settled with a site visit and a conversation. If we can't resolve it that way, we both agree to try mediation in good faith before going to court. Either side may still use small claims court for claims that qualify.
Which state's law applies
These terms and any work we do are governed by the laws of the Commonwealth of Massachusetts. Any court case goes to the state courts serving Hampden County, Massachusetts, unless the law where the work is done requires otherwise.
Changes to these terms
We may update these terms from time to time, and changes take effect when we post them on this page. The version in place when you signed your contract applies to that job.

If you have questions about these terms, call Agawam Concrete at (413) 789-3945, Monday through Sunday, 7 AM to 11 PM, or send us a message through our contact page. We respond within 1 business day.
